NYPD Lawsuit Aims to End Alleged Discrimination

A lawsuit filed by the New York Civil Liberties Union seeks to restrict a program that allows police to pull over some taxis and liveries, which officials believe allows officers to unconstitutionally question and search passengers, The Wall Street Journal reports.

The case against NYPD relates to its Taxi/Livery Robbery Inspection Program, called TRIP, which allows officers to pull over without cause any taxi or livery cab whose company has voluntarily enrolled in the program. The vehicles are identified by a decal and officers can visually inspect them and briefly question the driver.

But the ACLU alleges that on at least two occasions passengers were told they were subject to police questioning and searches because they were riding in a vehicle that participates in the program. The lawsuit states the program doesn’t allow officers to “detain, question, frisk or search passengers without independent suspicion of wrongdoing.”

The lawsuit seeks an injunction prohibiting officers from detaining, questioning or searching passengers based solely on the fact that the liveries and taxis are enrolled in the program.
